To observe the regime of work and rest
The deputies will consider the bill "about administrative liability of carriers for violation of the regime of work and rest of drivers for the carriage of passengers and cargo".
In the case of adoption the fatigue will meet not only the drivers themselves, but also their direct employer. It is proposed to amend article 11.23 of the code of administrative violations of "driving a vehicle or set the vehicle for the carriage of goods and (or) passengers without technical controls, the violation of the person driving the vehicle for the carriage of goods and (or) passengers, mode of work and rest".
Currently in part 2 of article 11.23 is said about the responsibility of a driver who has violated the established regime of work and rest. Soon to answer for this offense will be the employer. While the legislation stipulates an administrative fine in the amount from one thousand to three thousand roubles.
The bill proposes to suspend the activities of the transport companies whose drivers driving without a tachograph, for up to 90 days. While officials released the line it will put a fine in the amount of 7-10 thousand rubles. For legal entities the amount will increase up to 20-50 thousand. It is noteworthy that legal persons are equated to individual businessmen without forming a legal entity.
The same fines and penalties will be provided in the case, if the tachograph is, but the driver is not the driver fails to observe the established regime of work and rest. It is expected that with the advent of the responsibility of employers themselves will begin to follow the regime of work of their drivers.
The need for tougher legislation is long overdue. In order to save and struggle for higher profit employers often encourage drivers to overtime. The tachographs are often not installed at all. All this leads to an abundance of news about accidents involving heavy trucks and buses. If the driver of this car fell asleep, the accident could kill dozens of people.
