Last week came into force the order of the Ministry of internal Affairs of the Russian Federation from 21.12.2017 No. 948, which makes further changes to the new regulations of traffic police. The hot discussion was aroused by the paragraph according to which judges are equal to prosecutors and become virtually untouchable. So, inspectors of traffic police can not in any way affect: no to make the report, or hold examination for intoxication or to remove from the vehicle control. Now the interior Ministry explained the reason for such innovations.

According RBC, the Ministry of internal Affairs the introduction of the hotly debated norms, they argued the enforcement of regulations in accordance with the law "On status of judges".

In mid-March, the state Duma Deputy from the Communist party Valery Rashkin has sent a request to the Minister of internal Affairs Vladimir Kolokoltsev, which was asked to specify the reason for the introduction of changes in work of inspectors of traffic police with the judges.

"changes in terms of correction of specified provisions of this administrative regulation due to the need to bring it into conformity with the provisions of the law of the Russian Federation of 26 June 1992, n 3132-I "About the status of judges in the Russian Federation"", — stated in the answer Valery Rashkin. The letter was signed by first Deputy interior Minister Alexander Gorovoy.

The law "On status of judges" (in particular, article 16) gives judges immunity. The new administrative regulations of the traffic police, which entered into force on 20 October 2017, was allegedly deprived them of this privilege. In the case of identifying signs of intoxication, the judge could be removed from driving a vehicle and guide on medical testimony.

Thus, the interior Ministry tried to explain that the relationships between the inspectors, traffic police and judges simply returned to its original (up until October 20, 2017) level.
