Amendments to the law are designed to deal with the abdication of responsibility by drunk drivers
As have informed Agency "TASS" in the press centre of MIA of Russia, in 2019 it is planned to introduce criminal liability for drivers who fled the scene of the accident, which occurred in serious consequences.
To the current time the interior Ministry has developed the draft Federal law "On amendments to article 264 of the criminal code regarding strengthening of responsibility for crimes against traffic safety and transport operation".
The amendments are designed to toughen the penalties for drunk drivers. Today a paradoxical situation: fleeing from the scene of the accident drunk culprit is in a better position than anyone who has passed the examination and was recognized as drunk or refused examination. A day later, the law does not allow you to admit him drunk, since measurement of amount of alcohol will be biased.
The thing is that degrees of intoxication "is defined by the presence of absolute ethyl alcohol in the concentration exceeding a possible total error of measurement". Thus, the court cannot consider any other direct or indirect evidence that at the time of the accident the driver was drunk.
Earlier the constitutional court of Russia prismal this fact is contrary to the Constitution and proposed to amend the existing legislation changes. In this regard, the draft law introduces amendments to parts 2, 4 and 6 of article 264 of the criminal code "Violation of traffic rules and operation of vehicles".
