When hitting a pedestrian can leave the accused without a license
In the final third reading the deputies adopted the law on the introduction of a new measure of restraint — "prohibition of certain actions". The Criminal procedure code was amended, which may affect several areas of life, including automotive.
Now introduced a new article 105.1 of the RF criminal code, "the Prohibition of certain actions". Now the court can deny a suspect or accused to drive a car or other vehicle.
Here is the full text of the article: "the Court taking into account data on the identity of the suspect or accused, the factual circumstances of the criminal case and the parties' information when selecting a measure of restraint in the form of prohibition of certain actions can prevent a suspect or accused: go in certain periods of time outside of the dwelling in which he resides as an owner, tenant or on other legal grounds to reside in certain places, and closer set distance to certain objects, to attend certain events and participate in them, to communicate with certain individuals, send and receive postal and Telegraph dispatches, to use the means of communication and information-a telecommunication network the Internet, to drive a car or other vehicle, if the crime involves the violation of traffic rules and operation of the vehicle".
As you can see, driving is only one of many new preventive measures. When is the law determined the maximum period of application of the new measure: in criminal cases about crimes of small and moderate time limit of 12 months, serious crime — 24 months, and particularly grave crimes, 36 months.
a "Time of application of the prohibition of certain actions as a General rule the period of detention may not be envisaged as the ratio of the period of application of the measure of detention at banning exit from the premises — 2 days to 1 day", —stated in the explanatory Memorandum.
The restriction of the right driving can be applied to the drivers, made arrival on the people under investigation. In the trial, they will confiscate the driver's license.
